Per lettera, Juan (arrestato il 21 maggio 2019, dopo alcuni anni in clandestinità) fa sapere che sta ricevendo tutte le parole che gli vengono scritte, anche se la censura è abbastanza dura. Ha invece difficoltà a spedire le sue risposte e chiede un po’ di pazienza nel riceverle e di non farsi scoraggiare dal silenzio. Per il resto dice che è sereno e che sta bene.

Ciao a tutti amici e compagni! Sono Juan arrestato il 22 maggio [2019] dopo tre anni di latitanza. Scrivo dalla sezione AS2 del carcere di Terni in cui mi trovo rinchiuso. Sono sereno, il mio morale è equilibrato e sono determinato ad andare avanti.
In ogni giorno della mia clandestinità sono stato consapevole di poter finire in carcere; d’altronde lo sono sempre stato, fin dal giorno in cui ho deciso di lottare dalla parte degli oppressi.
Ciò che ha portato alla mia cattura è stata la mancanza di un insieme di accortezze che solitamente mettevo in atto. Ho abbassato la guardia nel momento sbagliato e nel posto sbagliato.
Non ho rimpianti, me l’assumo, vado oltre e che sia di lezione. In un altro momento scriverò come si è svolta la mia cattura.
Ma prima vi spiego la mia situazione giudiziaria per fare un breve quadro generale. Mi trovo in carcere per due filoni di indagini. Il primo riguarda un cumulo pena di nove anni (di cui tre li ho già scontati) collegati alla mia lotta/vita degli ultimi vent’anni trascorsi in Italia.
Le condanne sono per svariati reati tra cui furti, resistenze, rapina, vilipendio, danneggiamento, occupazione di luogo pubblico e privato, aggressioni, falsa identità. Fra queste condanne definitive c’è anche quella del “Processone” NO TAV (tre anni e nove mesi) su cui un futuro farò delle puntualizzazioni in quanto imputato Anarchico.
Sapendo che alcune di queste condanne sarebbero diventate esecutive, sono stato tre anni in fuga (e non per l’indagine relativa all’attentato alla POL GAI di Brescia, come invece sottolinea la magistratura). Senza alcun rimorso mi rivendico la mia fuga come atto di ripresa della mia libertà che va oltre qualsiasi autorità e legge.
Nel secondo filone, cominciata nel mio periodo di clandestinità, sono accusato di 270 [associazione sovversiva], 280 [attentato con finalità di terrorismo], 285 (strage) e nello specifico mi sono imputati due attentati. Il primo contro la POL GAI (scuola di polizia) rivendicato dalla Cellula Acca nel contesto del Dicembre nero [del] 2015. Il secondo attentato del 12/08/2018 riguarda due ordigni esplosivi, uno esploso e un altro pieno di chiodi in legno, scoperto dagli artificieri in forma di trappola per attirare i componenti dell’immobile e le forze dell’ordine; questi furono posizionati nella sede della Lega Nord di Treviso e furono rivendicati dalla cellula Haris Hatzimihelakis / Internazionale Nera 1881/2018. Di questa indagine non ne sono stato al corrente fino al giorno della mia cattura, contrariamente a quanto dichiara la magistratura per aggravare la misura cautelare di Manu, accusato di favoreggiamento. Tuttavia aspettiamo di avere un quadro più completo non appena l’indagine sarà chiusa.
Già una rapida lettura delle indagini preliminari di DIGOS e P. M. mi ha dato un indirizzo su ciò che vogliono reprimere. Nello specifico a me in quanto Anarchico e in generale alla realtà anarchica nel suo insieme. Nulla di nuovo che non sia già stato fatto in tutte le salse dalla magistratura. Riconoscere gli intenti repressivi è una bussola per capire a cosa realmente vogliono colpire e di conseguenza dove indirizzarci.
(A partire da questo punto, i virgolettati sono delle frasi prese dalle carte dell’indagine preliminare).
Secondo l’inchiesta, le rivendicazioni dei due attentati sarebbero collegate all’intervista di Alfredo Cospito sul giornale Anarchico “Vetriolo” [del] 2019 e ne rappresenterebbero “gli stessi contenuti e le medesime linee operative”… come se ci fossero delle direttive dall’alto. Le accuse sarebbero in concorso con i soliti ignoti perché, a parte il mio DNA riconosciuto parzialmente, ci sarebbe un altro DNA ignoto ricondotto al mio presunto complice. Da un lato vengono tirati in ballo i reati associativi, dall’altro rimarrei io l’unico ideatore, organizzatore ed esecutore. Insomma né carne né pesce.
A parte le mie battute ciniche, è palese la subdola intenzione della magistratura, con la sua aberrante ideologia di stato, di costruire dei capi ideatori della realtà anarchica, con tanto di linee operative da seguire e struttura gerarchica. Strategia adottata in questo caso specifico così come nelle ultime indagini che hanno colpito le realtà anarchiche. In questo caso, sarebbe Alfredo “uno dei maggiori e riconosciuti esponenti del movimento terroristico di matrice Anarchica attualmente detenuto nel c/c [casa circondariale] di Ferrara in espiazione della pena inflitta per l’attentato all’ingegnere Adinolfi”.
Lo Stato e la legge vorrebbero (come al solito) aggravare le accuse costruendo dei dirigenti a guida di una fantomatica organizzazione terroristica gerarchica, in maniera da manipolare e unificare tutto in un unico pentolone inquisitorio e sbatterci dentro gli “esponenti” della galassia anarchica. In questa maniera tentano di creare un clima spettacolare, predispongono il terreno per fare terra bruciata e per far scomparire qualsiasi istanza autonoma e di azione diretta della lotta anarchica.
Ma c’è di più. La magistratura vorrebbe inglobare la pratica dell’azione diretta anonima accorpando nell’indagine tali azioni “sebbene la rivendicazione delle sigle specifiche (il gesto veniva rivendicato dalla sedicente Cellula Haris Hatzimihelakis / Internazionale Nera 1881/2018) non sia ritenuta essenziale nel contesto delle iniziative anarchiche che ammettono anche iniziative anonime con vicende analoghe e con le modalità già utilizzate in altri attentati riconducibili al cartello FAI/FRI”. L’intento è dunque creare dei precedenti per le azioni di attacco anonime includendole nelle varie indagini quando più gli fa comodo, per costruire le loro fantasiose organizzazioni terroristiche con tanto di dirigenti creati ad hoc. Inoltre viene enfatizzato l’aspetto della solidarietà ai prigionieri anarchici e con chi si trova rinchiuso o rivolta più in generale.
Questi sono i punti chiave su cui si soffermano e che vogliono colpire e ammutolire, in quanto rappresentano le basi con cui gli anarchici continuano a sostenere pubblicamente certe pratiche (ci sono alcuni anarchici indagati per diverse pubblicazioni e condannati ad anni di prigione). In questa indagine, come in tutte quelle in corso contro gli anarchici, vogliono reprimere i concetti base della teoria e dell’azione anarchica, quali il rifiuto della delega, l’azione diretta, la solidarietà ai prigionieri rivoluzionari, le pratiche multiformi di attacco non gerarchiche e la ribellione permanente e refrattaria a qualsiasi autorità.
Il potere così ci segnala indirettamente che questi ultimi concetti base rimangono spuntati qualitativamente se non sono accompagnati da una proiezione prospetticamente nella lotta fianco a fianco agli sfruttati; è qui che ci colpiscono preventivamente.
C’è bisogno di avere una visione e un sentire comune che includa l’individuale e il collettivo in una alchimia di lotte locali e specifiche (come anarchici) intese come tattiche di lotte diverse e diversificate che però si concepiscono e si riconoscono nell’insieme della lotta generale e nella ricchezza della sua diversità metodologica e progettuale. Che costantemente va equilibrata a una prospettiva internazionalista e armonizzata al caos di infinite tattiche e strategie del anarchismo che confluiscono nella lotta universale per l’anarchia. Tutto ciò condito dalla essenza fondamentale dell’Anarchia; solidarietà universale a tutti i livelli della lotta\vita.
Lo Stato fa questo gioco per meglio colpirci e per riaffermare che non può esistere altra forma d’organizzazione sociale, salvo l’organizzazione autoritaria e gerarchica della società di oggi.
Il revisionismo del passato è un’arma potente che gli stati utilizzano per depotenziare le varie forme di rivolta del presente e per creare il vuoto attorno ai rivoluzionari di oggi e lasciarli senza radice e anima. Perciò è importante non dimenticare e divulgare le epoche trascorse, e fare tesoro della memoria delle lotte dei nostri compagni come stimolo per le lotte di oggi.
Basta uno sguardo al nostro passato per rendersi conto come certe tensioni e metodi siano da sempre stati utilizzati nella lotta anarchica, addirittura prima che nascesse l’internazionale anti autoritaria nel 1871.
Queste basi fondamentali me le rivendico a testa alta! Rifiuto qualsiasi teorema in cui mi vogliono incasellare, contrario ai miei più elementari principi in quanto anarchico.
E qui non si tratta di dire che la lotta è non violenta, o di farsi passare per angeli o per anime pie. Si tratta di chiamare le cose con il loro nome e di rivendicare le istanze combattive che gli anarchici, i ribelli e i rivoluzionari hanno utilizzato e utilizzano da sempre nel mondo intero.
Tutto ciò l’ho comunicato apertamente e pubblicamente da quando ho scelto di lottare attraverso una mia speciale concezione del anarchismo. Indipendentemente che sia responsabile o no dei fatti di cui mi accusate, io condivido e solidarizzo con la lotta e con le azioni di attacco al capitale e allo Stato. Che per sua natura è da sempre responsabile di stragi e genocidi nel mondo intero.

By letter, Juan (arrested on 21 May 2019, after a few years in hiding) lets it be known that he is receiving all the words that are written to him, even if the censorship is hard enough. Instead, he has difficulty in sending his answers and asks for a little patience in receiving them and not being discouraged by silence. For the rest, he says he is calm and well.

Hi to all friends and comrades! I’m Juan arrested on 22nd May [2019] after three years on the run. I’m writing from the AS2 unit of the prison of Terni, where I’m locked up. I’m calm, my morale is stable and I’m determined to move on.
Each day I was in hiding I was well aware that I could end up in jail; after all I’ve always been there, since the day I decided to struggle on the side of the oppressed.
My capture was due to a lack of a series of precautions that I normally took. I lowered my guard at the wrong time in the wrong place.
I have no regrets, I accept my responsibility, I’m getting over it and might it be a lesson. I’ll write about how my capture took place some other time.
But first I’m going to explain my judicial situation so as to give the general picture. I’m in prison because of two lines of investigation. The first concerns a consecutive sentence of nine years (three of which I have already served) linked to my struggle/life of the last twenty years spent in Italy.
The convictions are for various offences including theft, resistance, robbery, contempt, damage, occupation of public and private places, assault, false identity. Among these final convictions there is also that of the NO TAV “Big Trial” (three years and nine months), which I’ll make some points about some time in the future as an accused Anarchist.
Knowing that some of these sentences would come into effect, I spent three years on the run (and not because of the investigation concerning an attack on the POL GAI [police training centre] in Brescia, as the magistrates insist). With no regrets I claim my escape as an act of reconquering my freedom, which goes beyond all authority and law.
In the second line, which began during my time in hiding, I am accused of articles 270 [subversive association], 280 [attack with the purpose of terrorism], 285 (massacre) and I am accused of two attacks. The first against the POL GAI (police training centre) claimed by the Acca Cell in the context of black December in 2015. The second attack, on 12/08/2018, concerns two explosive devices, one which exploded and the other full of wooden nails, found by bomb disposal experts and intended to be a trap to attract the occupants of the building and the forces of order; these were placed at the premises of the Lega Nord [“Northern League” political party] of Treviso and claimed by the Haris Hatzimihelakis Cell / Black International 1881/2018. I wasn’t aware of this investigation until the day of my capture, contrary to what the judges are saying in order to worsen Manu’s custodial situation, as he is accused of aiding and abetting. However we are waiting for a more complete picture as soon as the investigation closes.
Already a quick reading of the DIGOS and prosecutors’ preliminary investigations gave me an idea of what they want to repress. Specifically against me as an Anarchist and generally against the anarchist reality as a whole. Nothing new that hasn’t been already done by judges in all sorts of ways. To recognize repressive intentions is a guide to understanding what they actually want to strike and consequently how to move.

According to the investigation, the claims of the two attacks are allegedly linked to an interview with Alfredo Cospito in the Anarchist paper “Vetriolo” [published in] 2019 and are supposed to represent “the same contents and the same operational lines”… as if there were orders from above. Charges are allegedly in cooperation with the usual unknown, because besides my DNA, partially identified, there would be another unknown DNA belonging to my presumed accomplice. On the one hand, associative crimes are brought into play, on the other I would be the only deviser, organizer and perpetrator. In other words, neither fish nor fowl.
My cynical jokes aside, it is clear there is an obvious intention by the magistrates, with their aberrant state ideology, to fabricate devisers-leaders in the anarchist reality, with operational lines to be followed and hierarchical structures. A strategy adopted in this specific case as well as in recent investigations that have struck anarchist realities. In this case, Alfredo is allegedly “one of the most important and recognised exponents of the terrorist movement of an Anarchist background currently imprisoned in the prison of Ferrara serving a sentence inflicted for the attack on Engineer Adinolfi”.
The State and the law (as usual) would like to make the accusations worse by fabricating leaders of an imaginary hierarchical terrorist organization, so as to manipulate and unify everything in one single inquisitive cauldron and throw the ‘representatives’ of the anarchist galaxy into it. In this way they are trying to create a spectacular atmosphere, they are preparing the ground to make scorched earth and eliminate any autonomous instances and direct action in the anarchist struggle.
But there is more. The judiciary would like to incorporate the practice of anonymous direct action by including such actions in the investigation “even if claims of specific acronyms (the action was claimed by so called Haris Hatzimihelakis Cell / Black International 1881/2018) are not considered essential in the context of anarchist initiatives which also accept anonymous initiatives with similar initiatives and with the modalities already used in other attacks attributed to the FAI/FRI group”. So the intention is to create precedents for anonymous actions of attack by including them in the various investigations when this suits them most, so that they can fabricate their imaginative terrorist organizations with leaders created ad hoc. Moreover the aspect of solidarity with anarchist prisoners and those who are locked up or generally those who revolt, is emphasized.
These are the key points that they linger over and which they want to strike and silence, because they represent the bases with which anarchists continue to support certain practices publicly (there are some anarchists under investigation for various publications and sentenced to years in prison). In this investigation, as in all those underway against anarchists, they want to repress the basic concepts of anarchist theory and action, such as refusal to delegate, direct action, solidarity with revolutionary prisoners, multiform non-hierarchical practices of attack and permanent rebellion averse to all forms of authority.
In this way power is telling us indirectly that these basic concepts remain qualitatively blunt if they are not accompanied prospectively with a projection into the struggle alongside the exploited; it is here that they are striking us preventively.
We need to have a common vision and feeling which includes the individual and the collective in an alchemy of local and specific struggles (as anarchists) intended as tactics of different and diversified struggles which are however born and recognize themselves in the whole of the general struggle and in the wealth of its methodological and projectual diversity. Which constantly needs to be in equilibrium with an internationalist perspective and harmonized in the chaos of infinite tactics and strategies of anarchism which flow into the universal struggle for anarchy. All this seasoned with the fundamental essence of Anarchy; universal solidarity at every level of the struggle/life.
The state is playing this game in order to strike us harder and to reaffirm that there can be no form of social organization other than the authoritarian and hierarchical one of today’s society.
Revisionism of the past is a powerful weapon that states use to disempower the various forms of revolt of the present time and create a void around today’s revolutionaries leaving them without roots or soul. That is why it is important to not forget but to propagate past epochs, and treasure the memory of our comrades’ struggle as a stimulus for the struggles of today.
A glance at our past is enough to realize that certain tensions and methods have always been used in the anarchist struggle, even before the birth of the antiauthoritarian international in 1871.
I claim these fundamental principles head held high! I refuse any theorem that they want to pigeonhole me in contrary to my most basic principles as an anarchist.
And here it is not a question of saying that the struggle is non-violent or of passing oneself off as angels or pious souls. It is a question of calling things by their name and claiming the instances of struggle that anarchists, rebels and revolutionaries use and have always used all over the world.
I have said all this openly and publicly ever since I chose to struggle through my special conception of anarchism. Regardless of whether I am responsible for the deeds I am accused of or not, I share and am in in solidarity with the struggle and the actions of attack on capital and the State. Which by its very nature is always responsible for the massacres and genocides all over the world.
