Italia: Aggiornamenti sulla situazione di Divine
Il 19 luglio [2019], al termine dell’udienza presso il CPR di Bari, il giudice non ha convalidato l’istanza di trattenimento presso il lager barese, le motivazioni per la detenzione non sono state giudicate sufficienti. Una volta lasciato il carcere per migranti peggiore d’Italia, l’iter successivo alla sospensione dell’espulsione emessa dalla Corte Europea dei Diritti dell’Uomo è andato avanti, il Ministero dell’Interno ha consegnato le memorie per giustificare l’espulsione e la difesa di Divine entro il 19 agosto consegnerà le proprie motivazioni a Strasburgo.
La linea che continua a perseguire il ministero è quella di descrivere il compagno come una persona socialmente pericolosa, un terrorista che deve essere espulso, malgrado lui non sia mai stato condannato per questi reati. Ancora una volta ci si palesa il funzionamento del diritto: l’accusa creata dai rancori dell’esecutivo conta più delle sentenze dei giudici, essa di per sé descrive alcuni soggetti come pericolosi criminali andando a comprometterne la vita intera. Dal 19 agosto in poi, quando Strasburgo avrà ricevuto tutte le carte necessarie, la Corte si esprimerà verosimilmente nei giorni successivi e se l’esito fosse negativo, esiste la possibilità che Divo venga rimpatriato all’istante, poiché l’eventuale ricorso non è sicuro che abbia l’istanza di sospensione dell’espulsione.
Chi lotta viene attaccato dallo Stato e dai tribunali, ma quando si tratta di persone che non sono nate in questo paese ovviamente i margini sono molto più ampi, ed è così che un diritto penale già eccezionale e dedicato al nemico interno, diventa ancor più eccezionale quando diventa diritto dell’immigrazione. Anche chi ha vissuto vent’anni in Italia deve fare i conti con le politiche di uno Stato che vuole essere inospitale e aggressivo contro la figura dell’immigrato, a patto che non sia ricco, ovviamente.

Even those who have lived in Italy for twenty years must deal with the policies of a State that wants to be inhospitable and aggressive against the figure of the immigrant, as long as it isn’t rich, of course.
